1. Agreement to Terms

By accessing or using the Promptolution LLC ("Promptolution," "we," "us," or "our") website and services, you ("Customer," "you," or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our website or purchase our products.

2. Description of Services

Promptolution creates and sells proprietary prompt templates that adhere to the Promptolution methodology ("Promptolution Systems"). Our products are delivered as PDF files containing:

  • Original written content and instructions

  • Promptolution Systems

  • Detailed usage guidelines and methodologies

Important: Promptolution does not provide access to large language models (LLMs). Customers must use their own LLM access with our systems.

3. Intellectual Property Rights

Our Intellectual Property

All Promptolution Systems, content, methodologies, trademarks, copyrights, and trade secrets are the exclusive property of Promptolution LLC. This includes but is not limited to:

  • The Promptolution methodology and framework

  • All written content, instructions, and documentation

  • Proprietary prompt templates and structures

  • Trademarks, logos, and brand elements

  • Trade secrets and confidential business information

Your Limited License

Upon purchase, you receive a limited, non-exclusive, non-transferable license to:

  • Use the Promptolution System for personal use only

  • Modify the Promptolution System for your personal use

  • Access and reference the provided instructions and documentation

Strict Prohibitions

You are expressly prohibited from:

  • Sharing or Distribution: Sharing, distributing, or providing access to any Promptolution System (original or modified) to any third party

  • Resale or Commercial Use: Selling, reselling, licensing, or using any Promptolution System for commercial purposes

  • Reverse Engineering: Attempting to reverse engineer, extract, or recreate our proprietary methodology

  • Competitive Use: Using our systems to create competing products or services

  • Unauthorized Reproduction: Copying, reproducing, or duplicating our content beyond personal use

  • Public Disclosure: Publishing, posting, or publicly sharing any portion of our systems or methodology

4. Product Testing and Compatibility

All Promptolution Systems are pre-tested to work on the following LLM platforms:

  • OpenAI ChatGPT

  • Anthropic Claude

  • Google Gemini

However, we do not guarantee compatibility with other platforms or future versions of these platforms.

5. Prohibited Uses

You may not use our website or products for any of the following prohibited purposes:

General Prohibitions

  • Any illegal, harmful, or unethical activities

  • Harassment, abuse, or harm to yourself or others

  • Violating any applicable laws or regulations

  • Infringing on others' intellectual property rights

Technical Prohibitions

  • Reverse engineering or attempting to extract our methodology

  • Circumventing copy protection or access restrictions

  • Bulk downloading or automated access to our website

  • Attempting to gain unauthorized access to our systems

AI-Specific Prohibitions

  • Creating harmful, discriminatory, or offensive AI outputs

  • Using our systems to generate illegal content

  • Developing competing AI prompt systems based on our methodology

  • Using our systems in ways that violate LLM platform terms of service

6. Sales and Refunds

No Refunds Policy

All sales are final. Due to the digital nature of our products, we do not offer refunds once a Promptolution System has been delivered to your email address.

Product Assurance

While we do not offer refunds, you can purchase with confidence knowing that all Promptolution Systems are thoroughly tested and proven to work with the specified LLM platforms.

7. User-Generated Content

Customer Reviews and Feedback

By submitting reviews, testimonials, feedback, or other content to Promptolution, you grant us:

  • Perpetual, worldwide, royalty-free rights to use, reproduce, and display your content

  • Rights to use your reviews and testimonials in our marketing materials

  • Rights to use customer success stories and case studies for promotional purposes

Content Standards

You warrant that any content you provide:

  • Does not violate any third party's rights

  • Is accurate and truthful

  • Does not contain harmful, offensive, or illegal material

Content Moderation

We reserve the right to remove, edit, or refuse any user-generated content that violates these Terms or is deemed inappropriate in our sole discretion.

8. Account Termination

Grounds for Termination

We may immediately terminate your access to our website and services, without notice, if you:

  • Use our products in ways that cause or could cause harm to yourself or others

  • Violate any intellectual property restrictions (sharing, reselling, or distributing our Promptolution Systems)

  • Attempt to reverse engineer or extract our proprietary methodology

  • Use our products for illegal activities

  • Harass Promptolution staff or other customers

  • Initiate chargebacks or payment disputes made in bad faith

  • Create competing products using our methodology

  • Violate any provision of these Terms

Effect of Termination

Upon termination:

  • Your access to our website and future purchases will be revoked

  • All license rights granted under these Terms immediately cease

  • You must cease all use of our intellectual property (except for personal use of previously purchased products)

9. Disclaimers and Limitations of Liability

Performance Disclaimers

PROMPTOLUTION MAKES NO WARRANTIES OR GUARANTEES REGARDING:

  • Specific outcomes or performance results from using our systems

  • The results or outputs generated by AI systems using our prompts

  • Compatibility with future versions of LLM platforms

  • Uninterrupted or error-free operation

AI Technology Disclaimers

We expressly disclaim responsibility for:

  • How customers use our Promptolution Systems with AI systems

  • AI-generated outputs or results customers receive

  • The evolving and unpredictable nature of AI technology

  • Customer modifications to our systems and resulting outcomes

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability to you is limited to the amount you paid for the specific product giving rise to the claim

  • We are not liable for any indirect, incidental, punitive, or consequential damages

  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose

Rationale for Limitations

These limitations exist because customers may modify our systems, and we have no control over such modifications or how customers implement our methodologies with various AI platforms.

10. Dispute Resolution

Informal Resolution Requirement

Before initiating any formal dispute resolution, you must first attempt to resolve any disagreement by contacting us at info@promptolution.ai and allowing 30 days for informal resolution.

Mandatory Arbitration

Any disputes not resolved informally must be resolved through binding arbitration in Wyoming under the rules of the American Arbitration Association. You waive any right to a jury trial or class action lawsuit.

Governing Law

These Terms are governed by Wyoming state law, without regard to conflict of law principles.

11. Modifications to Terms

We may modify these Terms at any time by posting updated terms on our website. Your continued use of our website and services after any changes constitutes acceptance of the new Terms. Changes take effect immediately upon posting.

12. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, along with our Privacy Policy, constitute the entire agreement between you and Promptolution.
